What's the problem with coming through a closed door anyway?

It can't be linked to probable cause. This was a college party, after all. They might as well have hung a neon sign outside saying: "Half of us are breaking the law in here."

Is it something to do with that weird notion that you can't get me if I cross the state line?

It makes me wonder why American jails are so full, when all you need to do to escape is drive to the next state, close your door and make sure you're sitting down when the music stops.

Don't take this wrong, folks. But in most states, most of you are very wrong in one way or another. I am not trying to criticize here, but to educate, because it looks like it is necessary.

*IF* -- and that is a big if -- a cop has probable cause, he can walk in without a warrant. But probable cause is not always an easy thing for a cop to prove.

If he or she does NOT have probable cause, they can be told to stay the hell outside, and they have no right to enter. In most cases, without probable cause, they do not even have the authority to force you to produce ID. They might ask -- they are trained to ask -- but remember that when a police officer ASKS and you comply, usually that means that you have just VOLUNTARILY given up certain rights.

And sorry, Nico99 but you are way off! Most states have "reciprocal agreements", which make it possible for cops to chase you across state lines if you have committed a crime. Further, even if that crime was a misdemeanor, crossing the state line to avoid punishment not only escalates things to the Federal level, it is a Federal FELONY! So don't try it, dude. If you want to hide, do it somewhere in the same state. Otherwise you could find not just the local cops but the FBI on your ass!

Back to "probable cause". "Suspicion" is NOT probable cause! A cop can suspect all he wants. A cop could have 1000 different "reasonable suspicions", as they call them, but that still does not constitute probable cause. Probable cause is some kind of direct evidence that a crime is being committed. So even if it is a college party, and the cop "reasonably suspects" that there are underage drinkers, for example, that is not probable cause. The cop would have to know somebody there who they KNEW to be underage, or perhaps SEE someone there who is CLEARLY underage, like maybe a 12-year-old, drinking. Not just suspect that underagers were present and drinking, but KNOW that they are. THAT is probable cause.

Anything else, and they are NOT doing their jobs. They are bullying and intimidating, which is not a part of their job. In fact, if it can be proven it can and should be grounds for firing their asses.

If you are a teenager or about college age, and want to be partying, you should know what your rights are, and what they are not. From your comments here, most of you do not have the slightest clue about what the law really is.

An ex-state-trooper named Barry Cooper has a DVD called "Never Get Busted Again", in which he clearly explains the difference between Reasonable Suspicion and Probable Cause. He also explains what you can do to assert your RIGHTS when necessary, in order to avoid intimidation or harassment by police. You can find that video available for sale via the internet.

There is also an excellent 45-minute educational video, entitled "Busted: What You Can Do to Survive Police Encounters", which has been posted on YouTube. I highly recommend it. Here is a link:

Hey jqp364. You're pretty much right in what you said. But there's one thing you left out. While "probable cause" is intended mainly to protect a person from unfairly being harrassed by cops, there was recently a Supreme Court ruling that weakens that protection quite a bit. The majority said that as long as the cop says he THOUGHT he had probable cause, then anything that follows can be used as evidence against you in court, even if it turns out he was wrong! What the specific case involved was a cop who did a traffic stop and CLAIMED he smelled marijuana in the car. So he ordered the people out, searched the car, and didn't find anything. The people in the car sued, and it eventually went all the way to the Supremes. So in the end the Court said as long as a cop SAYS he THOUGHT there was probable cause, the cop is off the hook.

Since that case, I've heard from several different people saying they've been pulled over by cops, and asked "have you been smoking marijuana in here" . . . at which point the cops search the car, hoping to get "lucky"! Sick but true!

There are extenuating circumstances in which a cop can enter your home without a warrant. We don't know enough info about this case to say one way or the other, so this whole discussion is pretty much worthless.

Let us not forget one thing...these were renters. I'm sure none of the people staying at this place were the owners of the property. In many college towns the landlords will have clauses placed into the lease agreements stating that he (the landlord) or his "agent" may enter the premisises if he believes the agreement is not being adhered to...Many of the landlords are putting "no alcohol" clauses in the lease agreements. I'm not saying that this was the case here, but it is possible. I have already seen this in practice where I work and it sticks in court.

@ nico, crossing state lines doesn't mean shit! Trust me, I know. Living in New England you can cross borders within minutes. Believe me, it doesn't mean shit if you cross the border. Once in pursuit, they can still pursue and call ahead, once the police in the state you have crossed into start in on the chase, the former state's police back off and you will be extradited to face charges in the state you first commited the offense. All the owner of the house or a roommate had to do was telll him to get the hell out or be reported he saw the camera and was already nervous cause he knew he'd be in deep shit. The only reason the Supreme Court ruling was justified was because the cop said he smelled marijuana just like you can smell alcohol the cop can search the vehicle for beer. They could have probably sued the police for that, he gave no verbal warning to open the door, no commands at all, anything he blantantly over stepped his authority.

Its a very limited thing the cops can abuse this just like they abuse alot of things. They can easily harrass you for alot of things.

Technically the cop did not have the right to merely walk into the house. Through the video you cannot hear any loud music, or any music that would be loud enough to disturb anyone outside of the residence.

If the officer wakled through the closed door, he himself is abusing his power. However, is there were people drinking/throwing up/fighting on the front lawn, there is a clear motive to go inside of the house to check for such things.

Also, if there was an obvious smell of marijuana useage coming from within the residence, the officer could (using his judgement) go inside of the house. But without this clear and obvious motive, he had no reason to go inside of the house, especially if he merely walked through a closed entrance way.

As for the roomies, they should have been attentive to the door at all times to ensure that this never happens. If there is something going on at your house and the cops come-a-knockin`, walk outside and close the door behind you. Unless the cops can obviously smell something, or they see something without entering (such as a beer bottle or bong), they may enter.

Overall, the cop seemed like a d-bag anyway for abusing his power. The camera guy was right about the closed door, and the cop was demeaning.

Just wanted to clarify something about my post re. the Supreme Court ruling.

It went way further than just saying that if a cop actually smelled MJ, he had probable cause to search. Of course that's been the case for a long time. No, what the SC said in this case was that a cop only had to SAY he smelled MJ. It doesn't matter if a million other people in the same situation would say, "I don't smell a thing." Doesn't matter. All that matters is that the cop is willing to swear to the fact that "I thought I smelled something." In other words, ANY cop, at ANY place, at ANY time has only to SAY he thinks he smells (or hears, or sees, or whatever) something, and then everything after that is fair game. In other, other words: A COP CAN LIE THROUGH HIS TEETH, AND UNLESS YOU (THE DEFENDANT) CAN **PROVE** HE WAS INTENTIONALLY LYING, YOU LOSE!

Oh, but of course we all know that most cops would NEVER be so dishonest, unethical, and willing to abuse their authority that way . . . don't we?

Honestly, cops aren't dishonorable where I live. Cops here get paid the most in the country too, so that can be a reason. But that could also mean that the power could get even further to their head since they are making $100k+ after 4 years or something like that. I suppose it's dependent on the cop themselves, rather than a precise career generalization.

Cops can say they smell something, but that's also weak evidence in court in the long run. When a cop lies you can easily appeal too, so it's not a lost cause to keep fighting for what's right.

If you hide your narcotics and vent the smell, the cop has minimal probable cause to search you. But, like you said, they can easily lie as well.

Overall, the law is a double-edged sword. It can work for you, but it can also easily hurt you.
