An automobile is considered a deadly weapon, and the driver left the scene of a crime, who evers fault it was. But if he left the scene with with the man injured or killed, it would be considered attempted murder or murder. It's my opinion, now find something sharp, slit your throat and end yourself.

Were you questioning the fact that this could be a case of manslaughter? Manslaughter is the unintentional killing of someone, which immediately contradicts your definition of murder being "premeditated and intentional".
And premeditated murder is a completely different crime. Not to mention haven't you heard of cold blooded and hot blooded murder charges? They are two totally different things.

Aaanyway, I was disputing that leaving the scene of a hit and run escalates a manslaughter charge to murder. murder is defined as killing someone intentially and with premeditaion. manslaughter is defined as unlawul killing without intent to kill. now im only going on the video but it looked to me like the guy in the white SUV knocked him down by accident....ergo it was not premeditated and not intentional. Maybe there is a backstory and he did a bruce willis on marcel wallace in Pulp Fiction....but i doubt it.

If such accident is the proximate cause of death or a serious injury, any person knowingly failing to stop and comply with the requirements of subsection (a) of this Code section shall be guilty of a felony and, upon conviction thereof, shall be punished by imprisonment for not less than one nor more than five years.
Alas it doesnt mention anything there about murdering a car so maybe you should send a strongly worded email to the georgia legislature offices to complain.

Haha, I'm too confused. I thought you were disputing the fact it could be either murder or manslaughter. It could be classified under either if the person actually died. If he hit the guy and he died and he was helping him, it would be manslaughter. If he hit the guy, drove off, and he died without helping he could MAYBE get murder chargers, because murder doesn't HAVE to be premeditated, which was my whole point.

And I was referring to the fact hit and runs dont only apply to human beings, you can get hit and run charges for running into other peoples cars as well which wouldn't constitute 5 years in prison.
Anyway, back to Georgia. You take one states penalties and apply it to a video where it isn't relevant, I'm going based on the definition which i looked up in 30 seconds, try that. I'm positive the definition was around be the Georgia statutes.

If the driver had comitted a felony (eg had just robbed a bank) when he hit that other guy and if the guy died, it would probably increase a manslaughter charge to murder. driving away from the scene of an accident when you have just bought milk in a 7-11 does not increase a manslaughter charge to murder as there is no predetermination to kill the guy. it called a traffic accident for a reason...cos it was an accident. just because you drive away from an accident doesnt mean the DA can argue that you hit the guy with the sole intention of killing him. im only stating a fact here, the law is pretty specific. wrt to the 5 years in prison, the line i quoted specifies "death of serious injury"...

This exact thing happened to me once, but I had the right of way. The guy hit me, I went up on the windshield and kind of rolled off. I got to my feet and yelled at the guy, who was stopped, but then he just hopped in his car a jetted off real fast. I was alright, minor break in my hand.

I would help the guy if he got run over like the previous comment. If you help you may be blammed for their injury. I mould stand a block away and call the police but other than that no way.
