No, he classified a car as a deadly weapon in the context of running someone over.. Which is the situation. At hand. And sorry, while the driver may not have had intent to run over her initially, the time elapsed between when she first went under his car, was dragged 20 feet, and came out the other end, removes any 'reasonable doubt.' If this had happened on a highway, where he didn't have time to turn or stop, that's one thing. However, he committed a deliberate act (slowly rolling up onto the victim) followed by a prolonged period using a device which, under those circumstances, can be considered a 'deadly weapon.' While he straddles the line between manslaughter and homicide, the victim's age and the pernicious nature of the action makes it realistic to charge him with the latter, more serious crime. All this parsing isn't really helping your argument.

No, actually, they mean pretty much nothing to me because I was too young to really remember anything from it. I have seen references to the lone man standing up against a tank but I have no clue what it was actually about. I wasn't refering to the issue that they were protesting on, only the fact that she chose not to move out of the way when 30 other people did. And I see the resemblance between Teineman Square there but sitting in the middle of the road doesn't make you a hero and it doesn't change anything. You draw attention to yourself but no real change is made. Using legal actions, getting a job in politics, etc. would be a much better way of ensuring change than sitting on the street. One of the people they were stopping in those cars could have been an activist on his way to deliver a proposition that would change things in favor of the protestors, you never know. Protesting like that is ignorant. Protesting in front of the whitehouse is different but blocking the street is just foolish.

While I tend to think the advantages (Civil Rights, unionization, the MOTHERFUCKING REVOLUTION) outweigh the disadvantages (work stoppages, lost productivity, occasional bouts of insanity) by a mile. However, gov't may place strictures upon the means of transportation, i.e. requiring a license, following driving laws, etc.
So walking (or the lack thereof, within public parameters) is a human right, which supersedes driving, which is only a state-sanctioned PRIVILEGE. The elevation of this man's driving privilege over their human rights of movement and freedom of assembly is not up to him to decide.

Sitting in the middle of a public street is not moving nor is it residing. By sitting down and blocking traffic, these protesters are preventing other people from moving. Your own message seems to back up my sentiment. These protesters were in the wrong. I don't care about what they were trying to do or say. They went about things in an entirely wrong manner.
I have a job with a global company. If I was held up due to a bunch of idiots sitting in the road I would be pissed off. I would warn them that I was going to drive on, then I would have driven on. You have the 'right' to drive onto those citizens who are blocking you from going to work. Likewise, you have the 'right' to surrender to the authorities when you are charged with the felony you would rightly deserve. What you don't seem to understand is that there is no absolute right -- rather, there are graduations of rights. Your right to gainful employment is not absolute, and barring a police officer exercising his legally binding judgment, your rights do not trump theirs. If everyone had 'gone about their business, nothing to see here' in the past, there'd be a lot more tyranny in this world. Also, if you happen to be enjoying that forty-hour work at that 'global company' you work for, know that the valuable overtime pay you receive is due to throngs of workers doing exactly what these kids were doing. Standing up for your beliefs should be a peaceful process. Blocking people led to anger which led to the scenes we saw in the video. No sitting in street = no running over. I am not against their rights to protest. I myself attended anti-war marches. They were planned out and properly policed. They did not lead to any problems and were recieved with good grace by the authorities. They didn't do a fucking thing to change anything, but I was happy to have voiced my opinions.
Why didn't these kids just protest outside their local congressman's home?
Sitting in the road was a stupid idea. The people sitting caused these problems. Protests can be a good thing, but not in a way that fucks up other people's lives.

However, driving is a PRIVILEGE, and the overarching rule of driving is YIELD TO PEDESTRIANS. The road itself is a public good, to be shared by all -- sorry, but drivers don't take precedence. As it is, do you really think police in a busy city like that wouldn't have arrived if the protest was deemed unlawful? It's not as if traffic was blocked in all directions, so patrol cars could have arrived. So either it was lawful, in which case the driver was wrong -- or it was not yet deemed unlawful, which means the driver is an impatient sot with little respect for police procedure. Sorry fanboys, but there's simply no defense for his behavior.

Umm, this is at the very least "a willful or depraved indifference to human life," which falls under the umbrella of involuntary manslaughter. Depending upon the state's sentencing guidelines, and if the girl in question had died, he could have gotten second-degree homicide. As she didn't, attempted homicide is a weighty charge, carrying penalties commensurate with misdemeanor manslaughter. And the victim was most likely underage, so yeah, he's fucked.

All wars have their protesters, the point I was making is that if lunatics with power are not fought against then these people would not be able to protest due to the fact that the freedom that they are using to complain would not exist. I notice you also said that driving is a privilege, fair comment, but where exactly does it say that the road is for sitting on, nowhere, if these people really wanted to protest so much why did they not do it in front of a military base or seat of government where there statement would have a truer and more focused impact rather than interrupting the lives of people who are going about their lawful business. As a result of this interference hardworking people were delayed in their daily work, ironically many of those who go on these demo's usually lead non productive lives and care little about what damage they cause to the livelihoods of others. In regards to the man who ran over the protester, he probably had no idea that there was going to be a demo and thus got trapped in it. However you may look at it, if you had been in that situation where you are trapped in your vehicle and you have a mob swarming around you banging away at your car and probably making all kinds of nasty comments(don't forget they were shouting at him and you have no idea what they were saying, and you know they won't admit to any incitive comments because everyone lies to keep themselves out of trouble and make themselves look good or innocent), don't for one minute think you would have done anything different to him. It's easy to make smug judgments when you've never been in that position, and I'll be honest with you if that had been me in that car and all I saw was a mob of idiots banging away at my vehicle and making obscene comments I would most likely have done the same, it's called self preservation. Don't make out you're any different because all that makes you is a liar or a fool.
